Attorney General won’t investigate Sheriff Turner

A representative of the state Attorney General said Wednesday his office won’t investigate Sheriff Donny Turner.

David S. McLaughlin, senior assistant attorney general, sent Coweta District Attorney Pete Skandalakis a letter saying Turner did nothing criminally wrong when he tried to intimidate a former employee into not campaigning for an opponent in the July 31 election.

“This conclusion only involves the question of criminality and not the ethical considerations presented by Sheriff Turner’s comments,” McLaughlin wrote.

Turner is accused of threatening the job of former sheriff’s department employee Jon Whitney, who has been head of security at West Georgia Health since 2007. Voter intimidation is a felony.

McLaughlin said Turner wasn’t trying to intimidate Whitney into not voting and an act of intimidation didn’t occur.

“The issue is not one of elector intimidation, but one of retaliation against Mr. Whitney for supporting another candidate,” McLaughlin said. The attorney general’s office also defined intimidation as “placing another person in reasonable fear for the person’s safety or the safety of another person.”

“There is no evidence that Sheriff Turner’s comments placed Mr. Whitney in reasonable fear for his safety or the safety of others,” McLaughlin said.

Turner said after the incident that he acted out because he was hurt seeing a former employee campaign for his opponent.

I remember when Gene Jones was sheriff and Mr. Turner has done a great job turning that county around since he was elected to office. Didn't he help the West Point Police dept. receive tasers?

Is McLaughlin afraid that Pete Skandalakis will pull his support? Look into what appointment McLaughlin has his eye on and who is helping him get there.

If Donny falls so do many others. If they don't keep him in office he could very well open his can of worms. PLEASE VOTERS OF TROUP COUNTY IT IS TIME TO TAKE OUR COUNTY BACK FROM THE GOOD OL'BOYS. They have been lining each other pockets for years as our County continues to suffer.

The AG's office has errantly stated that no crime was committed. This cannot be determined without an investigation. The now famous trascript in and of itself may not meet the threshold for a violation of Georgia code but to neglect the AG's duty to citizen's by refusing to investigate is inexcusable. How dare the DA's office give themselves this authority.

Every comment here is against what Turner did, as well it should be. I hope they equate that to the ballot box. i'm so tired of the " good ole boy " politics of this town, I hope we can " clean " some out this time around. It's not just Turner, it's from the mayor down, it seems. Was it just a " coincidence" that Ken Ragan was put in another district?

Since they have decided that what he did was not illegal, does that mean everyone else is fair game? If this isn't illegal whats stopping him from calling up everyone who supports Woodruff and threatening their jobs? This is a sham!

The law doesnt state it has TO : "INFLUENCE HIM NOT TO VOTE" if he uses his position of sheriff of the county to intimidate that man into thinking he was going to get him fired, which donny may have easily of been able to get done, ILLEGAL as it is, then he commited the act, doesnt matter if jon votes, doesnt vote, votes for a third, turned said he was going to talk to his bosses because he didnt support him as candidate, THAT IS ILLEGAL PEOPLE!!!!!!!!!!!!READ THE LAW DA, we out to vote this State DA out too!

I strongly urge voters to take this serious and go to the polls and do what it appears that no one else will.... remove Turner!! My issue with him is Ethics.. how can you manage a staff effectively if you are out there protecting and serving on emotions.. If his deputies had done this then they would have been suspended or terminated.. Simple as that. Everyone says that he is human, sure he is and he is entitled to be hurt by the actions of a former friend. He is also a grown man who ran and is holding a public office as holds camps to teach kids about law enforcement and ethics and so forth so is this what you want him to teach your kids? A man with integrity would not have made this kind of mistake... when a person is voted in office, they work for the people and when you personally attack just one of them, then they have friends who have friends who have friends and pretty soon you have just affected half of the people who you work for...

So if I understand this correctly, the sheriff can tell anyone campaigning against him that he is "going to get your ass" and the state will not consider it intimidation? AND, the next time there is a domestic situation or the fear of an outbreak at the hospital, we, as citizens of Troup County, shouldn't expect the Sheriff's Department to assist since Turner is angry with the hospital security?

Our Sheriff can break the law ( i think ) and get away with it !!!! See if any citizen could do the same...I THINK NOT !!! It's a SAD day in Troup County if he is re-elected. I had planned to vote for Sheriff Turner, but NOT now!!

Of course it had to come out this way. Politics at its finest. Did anyone read the article today in the TCN? I thought it was about the second coming of Jesus but it turned out to be nothing but an endorsement of Mr. Turner.

I do think that the Sheriff has cracked the door for the citizens to walk through. We have a chance to change the direction in which this county is going and hopefully we will take advantage of it by voting out all of the incumbents.

What about the Mayor being considered for Judge? A former car salesman, turned Mayor, that hasn't practiced law for 30 years. Seriously there is no way he is qualified for that position. But that's politics good ole boy style.

Who will enforce the spirit of the law?

The Lagrange Daily news reports that the Attorney General’s office will not proceed with a case against our sheriff. This is apparently because the OCGA 21-2-567 felony of intimidating an elector applies only to a person in the process of voting, not in the process of campaigning. Similarly, the federal voting rights act would seem to protect only minorities in the process of exercising the right to vote. While a strict reading of these statutes has yielded these unsatisfactory results, what ever happened to the spirit of the law?

In some cultures, an official caught doing what our sheriff did would immediately resign in order to save a modicum of dignity. Since saving face is clearly unimportant, we cannot hope that a voluntary resignation will occur. There seems to be too much materialism in this punishment/reward/religion dominated culture for that to happen. So, is that the end of this story? Maybe not.

With over 70,000 hits on the “Sheriff Turner threatens….” story in a county with a population of about 67,000, one can safely assume that lots of voters are upset because what the sheriff did is very, very wrong. Notwithstanding the technical outcome from the Attorney General’s office, we cherish liberty, and we must tolerate no assault on it.



Who will enforce the spirit of the law? In this case, it will be left up to the voters.

amen, I can read the law clearly and he intimiadated jon by telling him since he didnt scratch his back he was going to fire him. Im going to do EVERYTHING in my power to make sure they are never elected again. I guess in Georgia the law only applies to some people, not everyone. nick yancey 706 304 3240

Somehow knew this would happen unfortunately. Does anyone remember a few years back when Turner changed parties and it was rumored it was based on the State electing the first Republican governor since restoration and being a Republican could benefit him? Well I guess it has.

I encourage the voters of this county to see him for what he is, a BULLY. I just received copies of court transcripts involving a case brought against him in 1992. His friend Judge Prescott had that matter taken care of for him. It was found that though his actions may have not been "illegal", though that is up for debate, they were certainly unethical. The Smith family will forever be scarred by Turner's involvement with their family.

Threat of retaliation IS intimidation!!

Turner clearly has friends in high places. I suppose I shouldn't be surprised, but I am...and furious.

But I will channel that anger into the ballot box and vote to ensure that this is Turner's last hurrah.

I hope my neighbors will do the same.

so exersising his power and influence to get him fired doesn't count??? Interesting, but really did anyone see this turning out different...it is up to us voters...
