Trooper sentenced for causing wreck

A state trooper who took the sleep aid Ambien while on duty, then caused serious injuries in a traffic accident moments later, was sentenced Monday on two misdemeanor charges in Troup County State Court.

Phillip Hanners Jr. of LaGrange pleaded no-contest to driving 14 mph over the 55 mph speed limit and guilty to driving on the wrong side of the road. A 12-month jail term was suspended on the condition that he pay fines totaling $1,512, complete a driver-improvement course, perform 10 days of community service, not drive for 180 days except for essential reasons and not violate any state laws for a year.

Hanners, 42, entered a plea agreement with Coweta County State Court Solicitor-General Robert Stokely, who was appointed as special prosecutor after the Troup County solicitor’s office recused itself. Troup State Court Judge Jeannette Little also recused herself and arranged for Andy Prather, a state court judge in Columbus, to hear the case.

The accident victims, Robert and Gayle Hendrix of Bass Cross Road, said they don’t believe justice was served in the case.

“We feel that Mr. Hanners has been given special consideration of his actions because he is a Georgia state trooper,” Gayle Hendrix told Prather in a written statement. “The law is the law and should be the same for everyone.”

Stokely denied any favoritism, saying, “It’s ridiculous to think I would risk my reputation and career to cover for Phillip Hanners. What’s in it for me?”

The Hendrix couple were northbound on Hogansville Road on the evening of Aug. 27 when Hanners’ southbound patrol car veered into their lane and hit the left rear wheel of the van, which overturned several times. The patrol car hit a pine tree.

Hanners suffered a concussion and other injuries. Gayle Hendrix said she received lacerations to her right arm and hand, and her husband received a fractured vertebrae, which caused permanent nerve damage to his left forefinger and limited mobility in his neck, permanent injury to the left side of his brain, a head injury that required plastic surgery and a broken thumb.

“We have suffered both physically, financially and mentally,” she said. “The trauma of the accident has caused many emotions, confusion, shock, anger and depression.”

Hanners and his attorney, Robert Perkerson of Zebulon, didn’t say anything at Monday’s hearing and declined comment afterward.

Gayle Hendrix said she believes Hanners fell asleep at the wheel, which would explain why the patrol car was in the wrong lane going 87 mph at impact.

“If Robert had not turned the wheel of our vehicle … there would have been a head-on collision” and everyone would have died, she said.

Stokely said a computer in the patrol car records speed only at intervals and it can be said only that he was driving at least in the 60s at impact. In addition, a witness driving behind the patrol car said it didn’t appear he was going much beyond the speed limit, Stokely said.

Stokely said Hanners told him he took Ambien at his last traffic stop a few minutes before the accident, but has no memory of the accident itself.

“He said it usually took hours to work if at all and that was the reason he took Ambien when he did,” Stokely said. “… He was just about to go off duty. He said he would have been home in 10 minutes if the wreck had not happened.”

He said he doesn’t believe Hanners fell asleep because he appeared alert on the patrol car’s video at the last traffic stop. He said experts told him that Ambien generally takes 30 to 40 minutes to produce sleep, but Gayle Hendrix said her research showed the drug can cause a hypnotic effect after 15 minutes or less.

Stokely said “a number of things” could have caused the accident.

“He could have dropped something or he was fooling with the radio or was distracted by something on the side of the road,” Stokely said. “He was too alert moments before to have fallen asleep.”

A grand jury declined to indict Hanners on two other charges that it was asked to consider: driving too fast for conditions and criminal negligence, which described Hanners taken Ambien as a “willful, wanton and reckless disregard for the safety of other who might reasonably be expected to be injured thereby.”

Peter Alford, the Hendrix couple’s attorney, said Stokely could have gotten a DUI or felony charge out of the grand jury.

“You get the results you want from a grand jury,” Alford said. “They return bills of indictment for what the prosecutor wants. That’s just the way it goes. I don’t quite understand why he didn’t prosecute him for the Ambien.”

But he said Stokely is a friend who is “just as good as they come. I honestly feel he did what he believes was right.” Hanners also is a fine person, he said, but “sometimes great people make bad decisions. Certainly that’s what happened here.”

Stokely said the mere presence of Ambien in a person’s bloodstream doesn’t prove impairment as required for a DUI conviction. A review of the video from Hanners’ last traffic stop doesn’t show impairment, he said.

Gayle Hendrix said Stokely had told her family, “We have to be careful how we handle the case because we could ruin his career.” Stokely defended the statement, saying a trooper would be more affected by criminal charges than people in most other occupations.

“I said we should take our time because the charges have ramifications that are different for him than other people,” he said. “I told them I had no qualms about prosecuting a police officer.”

The Hendrixes filed a lawsuit against the Georgia Department of Public Safety, which has admitted liability, and a trial is scheduled for May to determine any monetary damages, Gayle Hendrix said.

Hanners was demoted from trooper first class to radio operator because of the accident.

I must admit that after reading the newspaper article and the comments made by this woman's family I feel for the Hanners' family. You people act like you were the only ones in this wreck. Do you have any idea what is like to be an officer in today's society??? Do you have any idea what this man faces every day for the citizens of Georgia and yes that includes you and your family! I have law enforcement in my family and I know what they face and deal with and I also know how people like to crucify them at any given chance! I have a hard time believing that there is not another side to this story. For instance, the paper stated he was getting off duty and was on his way home which was and I quote "ten minutes away." There is no drug around except for those induce by IV that could take effect that quickly. I know this because I have medical professionals in my family! It sounds like to me that he knew his meds and what they would and would not do to his system. After reading the comment that "Gayla" posted about Kelly May let me say that it is one thing to take cheap shots and hit below the belt to soothe your own anger but to use someone's deceased child to do so is gutless and pathetic!

I am sure his family does not appreciate you digging him up in such a mean vile way! I know a little about his Mom and she appears to be a classy lady and I can't believe she would condone you using her son's memory to bash "Trooper Hanners." To the Hanners' family let me say hang in there and thanks Trooper Hanners for the job you do!

Most plants in LaGrange has drug screenings, and if you test positive for drugs, then you are fired. But I guess the Georgia State Patrols are exempt from this policy. They can keep on working or should I say sleeping.

How DARE you bring Kelly May into this!!! He was one of our best friends. This has NOTHING to do with him!!! WE CHOOSE to remember the GOOD in KELLY and WE CHOOSE not to place blame on who did what, like your family seems to be doing!!! (The Officer, the justice system, the judge) There was a mistake made that cost Kelly his life and sure we would LOVE to put the blame on the trooper or anyone else for that matter but that will NEVER bring him back!!! Why harp on something that will never have a different outcome?? I dont know the trooper personally, but, I DO know GOD and I believe in looking past the anger & blame and seeing the good in what we have now. WE HAVE KELLY'S MEMORY!!!!

Gayla. Again you talk about what you have no clue about. From what I read the Kelly May ordeal was tragic, but could of been prevented just by stopping for the Trooper. It is sad for that family, very much so, but I dont believe they hold the same thoughts or think the same way you do. Matter of fact I have talked to Kellys mother, so I do know. But you are correct, for once, Rest In Peace Kelly May, you will never be forgotten. That was a promise made to his mother. I know that as well. So Gayla, do us ALL a favor, get your facts straight before you post a remark, people do know, and it only makes you appear, well what you are...SAD.

Well, I wasn't going to post to this, because my sister, Gayle, asked me not to, but since you brought my daddy into this, I couldn't hold back.

Jessie Hanners was a good, honest, respectable and dedicated law enforcement officer. He upheld the law and was not prejudice in any circumstances. The law was the law no matter if it was the good town doctor (daddy charged him with a DUI). He thought well of Mike Hanners and I believe Mike thought well of my daddy. Back then, there was the reputation of a law enforcement officers that people could trust to help them in need. If my daddy was alive today and in law enforcements, he would call Phillip Hanners a disgrace to all law enforcements agencies.

I am not shocked that there was no justice in a court of law in this day. Judge Little dismissed herself from the case because she was a friend to Phillip Hanners family, but she still help them out by getting her friend to judge the case. He was like her puppet, he did what any friend to Phillip Hanners would have done.

Come on, any lawyers out there reading these post, what would you charge a man driving on the wrong side of the road, going as fast as the car would go, drugs in his system and almost killing two inocent people? Shame...Shame on you Judge and solicitor.

About my brother-in-law and sister, if their vehicle had not slowed Phillip Hanners down before he hit that tree, Phillip Hanners would be dead today. I have seen the changes in Robert Hendrix since the accident, and it will be for the rest of his life. He may be able push a lawn mower, but I saw him trying to pick up a wienner off a grill with two hands and I felt so sorry for him that tears filled my eyes. It was like he had to concentrate so hard to get his hands to pick up the wienner. This is now, but what will another 3 months or a year be like in the life of Robert Hendrix and his wife Gayle, my sister.

I do not see how the Georgia State Patrols will stand by and see the reputation of law enforcements be put to shame. I know my daddy, Jessie O'neal Hanners would not. By the way today would have been my Dad's birthday. This statment is kinda like a birthday present for him. Standing up for the truth...Happy Birthday, Daddy, I love you!

I just thought of another incident to prove Phillip Hanners' worth as a "trooper". And no I don't know all the facts, before you going trying to run your mouth, I am speaking my mind... If you don't like it there are plenty of other websites you can go it, try youtube or something (search for crooked cops)... How about KELLY MAY!!??? Ring any bells!!! Yeah, I said it!!! I just read something funny. Peter Alford WANTING someone charged with DUI. Fork tounged arent we Mr. Alford? You represented my ex who was charged with DUI (drugs) I believe YOU, Mr. Alford, were doing your HARDEST to GET HIM OFF!!!! If i recall it was because THEY COULDN'T PROVE DUI WITH DRUGS, and apparently it was not even a HIGH amount, whatever that means. I am not a lawyer, nor do i know much about the law so Mr. Alford being a lawyer, Why is it you want someone charged NOW? Who cares that he is a Georgia State Patrol that is just his Job. From what i read he was charged with Traffic offenses (wrong side of the road and speeding), If going to jail is the cure than I think the jail would be severly overcrowded. I have read where people were charged with Homicide (i think that is what its called) and not put in jail. There are VERY FEW, if any, that have not received traffic tickets similar to these at one point!!!! I myself have and i guess i should have gone to jail. huh???

I believe in our justice system, Its the Lawyers trying to make a buck that I don't believe in!!!!

Gayla. Last time I saw Mr Hendricks he was doing quiet well, cutting grass and doing yard work. As for Gayle Hendricks, if her father Jessie Hanners, yes, see that last name,,HANNERS, if he was still alive none of this would be going on. JESSIE HANNERS, imagine that. You should know all the facts gayla, facts, not what your Aunt states, but the facts before you open your mouth about things you have no clue about. I know Mr Hanners and he is a good person, and I also know your Aunt, and how she has to be in total control, of everything, atleast when it comes to family. Becareful what you say or intice to provoke, you may have some doors open and the truth you dont want out. Go Tech

You know, I have been reading the comments made by the Hendrix family and although I hate what has happened to your family, I am sure that the Hanners have suffered as well. Jail??? You say, Gayla, well you explain what exactly that will solve?? Your family's feelings will still be the same. The justice system may not have satisfied you and your family but I believe that Mr. Robert Stokely did EXACTLY what he he would have in ANY other situation!! He doesnt care who or what you are and treats everyone equal from what I have heard of his reputation.As for sleeping pills, EVERYONE reacts differently to different drugs, Some work for people that DO NOT work for others, maybe that is something you and your family need to research.

Look at what happened to Mr. Rick Massie,a law enforcement officer, the kid that almost took his life just paid a simple fine and yet Mr. Massie lost his career!!!! You never here about what they have to deal with on a daily basis and yet your family feels like they know how TROOPER Hanners and his family feels??? hummm.. Your family has the right to feel the way you do. We all have a right to our own opinions. I am sure there are skeletons in your family's closet so let the JUDGEMENT ONLY be MADE BY GOD!!!!

Sometimes things happen that we wish never did and that change someones life forever well that is what has happened. Placing blame on the trooper and the justice system will not make it disappear or make how you feel change. I am glad that everyone is still alive!!! That is the greatest GIFT of all!!!!

I understand being angry about this situation. I probably would be too. I do know that sometimes things dont always go the way you want! That is just a part of life. I live in the Hogansville area close to the Hendrix. I have seen on many occasions of Mr Hendrix outside cutting grass and working around the yard. Their may be limitations but maybe his family can find things that can be done that CAN include him... something to think about.

I am the neice of Gayle and Robert Hendrix and the fact that this so called "upstanding trooper" got away scott free with this DISGUST me. As he states below, he can't say anything due to the pending civil lawsuit. I feel what he has to say is pointless anyway. He should have paid for what he did to two innocent people who have never harmed anyone. Law enforcement officals are supposed to set an example for the rest of the community, which is obvious in this case he DID NOT. Justice was not served in this case and being demoted to a radio operator??? He should be in jail, where anyone else who commited this CRIME would be. Just because he has a badge does not make him more important than those of us who don't! So, yes you may have got away with ruining my uncles life but I hope you can't sleep at night knowing what you did to OUR FAMILY. And for his facts that the people of Troup County need to know, how about that he failed as a law enforcement offical and almost took the life of two other people??? You should wait till you get home before you take your sleeping pills! I am disappointed in Court system to let this type of unjustice happen in our county.

this is robert and gayle's grandson. my grandmother was right, the justice was not served. justice needs to be served. my grandfather used to get out in the yard with all of his grandkids. we would play baseball, football, he even played paintball with me. now he cant do any of that, now when we are playing, you could see it in his eyes. he wants to play so bad but cant. he will never be the same. and its not right. the justice system is not thinking about what this family has gone through.

Citizens of Troup County. I am the Trooper who is named in this article.. The paper stated I had no comment, and due to a civil lawsuit I cant comment at this time. But there are many things to say, and when all is said and done ref this accident, I promise you will know all the facts about this accident, and a few other items I feel the people of Troup County need to know.
